THIS MOTION, made by the Plaintiffs for judgment in accordance with the statement of claim was heard this day at Kitchener, Ontario.
ON READING the statement of claim, the motion record of the Plaintiffs, the factum of the Plaintiffs and on hearing the submissions of counsel for the Plaintiffs, the defendant appearing in person:
1. THIS COURT ORDERS AND ADJUDGES that the Plaintiffs be granted a permanent injunction restraining the defendant from publishing, circulating, distributing, communicating or otherwise transmitting libellous or slanderous words or allegations against the plaintiffs or the Children's Aid Society of the regional Municipality of Waterloo, also known as Family and Children's Services of the Waterloo Region or any of its staff members.
2. THIS COURT ORDERS that the defendant pay the plaintiffs costs of this action fixed in the amount of $7,000.00 inclusive of GST and disbursements. Costs payable forthwith.
3. THIS JUDGMENT BEARS INTEREST at the rate of 4 per cent per year commencing on January 27, 2005.
